Welcome to WellBought. These Terms of Service (the “Terms”) govern your access to and use of the WellBought website and vehicle-purchase support and facilitation services (collectively, the “Service”) provided by WellBought (“WellBought,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.
1. What WellBought Is
WellBought is an independent vehicle-purchase support and facilitation service. We help buyers identify strong vehicle opportunities, compare complete deals, coordinate communication with dealerships, prepare a first-class dealership visit, and provide aftercare check-ins following a purchase.
WellBought does not sell vehicles. WellBought is not a dealer, broker, lender, insurer, mechanic, or extended-warranty provider. All vehicles are sold by independent dealerships, and all financing, insurance, and warranty products are provided by third parties.
2. Buyer Decisions
You, the buyer, remain in control of every material decision. That includes but is not limited to: the vehicle you purchase, the dealership you purchase from, the price you agree to, any trade-in terms, any financing or lease terms, any add-on products, and every signature on every document.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to use the Service.
4. Accounts
Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly through the Contact page if you suspect unauthorized access.
5. Service Fee
WellBought charges a single flat service fee of $299 USD per activated buyer engagement. WellBought receives no payment, commission, kickback, or referral fee from any dealership, lender, insurer, or third party. The fee becomes payable only after WellBought reviews your Buyer Discovery and confirms we can support your search. See Refunds and Cancellations below for refund terms.
Refunds and Cancellations
The WellBought service fee is generally non-refundable after verified payment and activation. “Activation” occurs when WellBought receives verified payment and marks the buyer’s service as active.
Once activated, WellBought may begin allocating staff time, reviewing the Buyer Discovery, preparing the Buyer Brief, conducting research, and coordinating the search on the buyer’s behalf. Because that work commits real resources, the fee is generally non-refundable at that point.
WellBought may, at its discretion, approve a full or partial refund based on the circumstances of a specific engagement.
A buyer changing their mind, pausing the search, rejecting opportunities offered by dealerships, experiencing financing denial, or otherwise deciding not to purchase a vehicle does not automatically create a refund entitlement.
Nothing in this section limits any rights or remedies that cannot legally be waived under applicable law.
Refund-review requests should be submitted through the Contact page, or from the Support Center inside your account. Please include the name and email on your WellBought account and a brief description of your request.
At checkout, buyers acknowledge: “I have reviewed and agree to the Terms of Service, including the Refunds and Cancellations section. I understand that the $299 WellBought service fee is generally non-refundable after verified payment and activation, except where required by law or where WellBought approves a refund based on the circumstances.”
6. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information;
- Use the Service for anything other than a genuine personal vehicle purchase;
- Attempt to interfere with, disrupt, or reverse-engineer the Service;
- Copy, resell, or commercially exploit any part of the Service without permission;
- Use the Service to harass or mistreat WellBought staff or dealership personnel.
We may suspend or terminate accounts that violate these Terms.
7. Third-Party Dealerships and Products
Any purchase, financing, lease, insurance, warranty, or service product you obtain is a transaction between you and the applicable third party. WellBought is not a party to those transactions and is not responsible for the vehicles, products, pricing, disclosures, conduct, or performance of any dealership or third-party provider.
8. No Legal, Financial, or Mechanical Advice
Information WellBought provides is for general guidance in connection with your car purchase. It is not legal, tax, financial, insurance, or mechanical advice. For advice specific to your situation, consult a qualified professional.
9. Communications
By using the Service you consent to receive service-related communications from WellBought by email and, if you opt in, by SMS. Message and data rates may apply. You may opt out of SMS by replying STOP.
10. Intellectual Property
The Service, including the WellBought name, logo, and all site content, is owned by WellBought and protected by intellectual-property laws. You may not use our marks or content without our written permission.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WELLBOUGHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ANY SPECIFIC VEHICLE, PRICE, TIMELINE, OR OUTCOME.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WELLBOUGHT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO WELLBOUGHT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend and indemnify WellBought against claims arising from your use of the Service, your breach of these Terms, or your interactions with any dealership, lender, or third party.
14. Termination
We may suspend or terminate access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.
15. Governing Law
These Terms are governed by the laws of the State in which WellBought is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located there, and you consent to their exclusive jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
